Terms and Conditions of Sale (TCS)

Article 1 - Purpose and scope These General Terms and Conditions of Sale (GTC) apply, without restriction or reservation, to all sales concluded by the company LUMINEUSE ("the Seller") to non-professional buyers ("the Customers" or "the Customer"), wishing to purchase products offered for sale on the website lumineuse-france.fr. They specify, in particular, the conditions for ordering, payment, delivery, and management of any product returns.

Article 2 - Seller's contact details The Seller is the company LUMINEUSE, a simplified joint-stock company (SAS) with a capital of €100.00, whose registered office is located at 517 Avenue de la Libération, 04100 Manosque, registered with the Manosque Trade and Companies Register under number 102 241 262.

Article 3 - Products and availability The products offered for sale are those listed on the website lumineuse-france.fr on the day the Customer consults the site. The main characteristics of the products (travel toothbrushes, oral care products) are presented on each product sheet. Product offers are valid as long as they are visible on the website, within the limits of available stock.

Article 4 - Prices The prices of our products are indicated in euros, all taxes included (TTC), excluding processing and shipping costs. The company LUMINEUSE reserves the right to modify its prices at any time, but the product will be invoiced based on the rate in force at the time the order is confirmed.

Article 5 - Orders and payment methods Confirmation of the order implies acceptance of all these GTC. Payment for purchases is made by credit card or any other secure payment method offered on the site (via Shopify Payments, Stripe, etc.). The Seller does not store any banking data.

Article 6 - Delivery Deliveries are made to the address indicated on the order form. Delivery times are given for information only. In the event of a shipping delay, an email will be sent to the Customer. In the case of delivery by a carrier, the company LUMINEUSE cannot be held responsible for delivery delays due exclusively to the customer's unavailability after several appointment proposals.

Article 7 - Right of withdrawal and exceptions (Hygiene) In accordance with the provisions of Article L.221-18 of the Consumer Code, the Customer has a period of 14 days from receipt of their products to exercise their right of withdrawal without having to justify reasons or pay a penalty. Important exception: In accordance with Article L.221-28 of the Consumer Code, the right of withdrawal cannot be exercised for contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection. Consequently, toothbrushes and oral care products whose packaging has been opened will not be returned or refunded.

Article 8 - Legal guarantees All our products benefit from the legal guarantee of conformity (Articles L.217-4 et seq. of the Consumer Code) and the guarantee against hidden defects (Articles 1641 et seq. of the Civil Code), allowing the Customer to return defective or non-compliant delivered products.

Article 9 - Intellectual property All elements of the website lumineuse-france.fr are and remain the exclusive intellectual property of the company LUMINEUSE. No one is authorized to reproduce, exploit, or use, for any purpose whatsoever, even partially, elements of the website.

Article 10 - Applicable law and disputes These GTC are subject to French law. In the event of a dispute, French courts will have sole jurisdiction. Before any legal action, the Customer is invited to contact the Seller to try and find an amicable solution.
